Consumer Rights & Cancellation Policy

1. General Provisions

1. By placing an order or starting a subscription through the İkago website or cloud platform, you agree to the preliminary information form and distance sales terms.
2. Buyers are subject to Law No. 6502 on Consumer Protection, the Distance Contracts Regulation, and related commercial legislation regarding the sale and delivery of cloud SaaS software services.
3. İkago software and licensing services are delivered digitally. In the event that any physical hardware shipment occurs, shipping and handling expenses shall be borne by the buyer.
4. Purchased services are activated fully in accordance with the specified package specifications, features, and agreed terms.
5. If fulfillment of the service becomes impossible due to force majeure, the seller shall notify the buyer in writing within 3 (three) days and refund the total fee paid within 14 (fourteen) days.

2. Non-Payment of Service Fee

1. If the buyer fails to pay the service fee, cancels the bank transaction, or if payment authorization fails, the seller's obligation to deliver or maintain active access to the service terminates immediately.

3. Unauthorized Use of Credit Cards

1. If, after activation of the service, the credit card used by the buyer is found to have been used unlawfully by unauthorized third parties and payment is withheld or revoked by the issuing financial institution, access to the platform will be suspended immediately.

4. Force Majeure & Delayed Delivery

1. In case of force majeure beyond the control of the seller (natural disasters, telecommunication outages, governmental restrictions), the buyer shall be informed promptly. The buyer may cancel the order or postpone delivery until the obstacle is resolved. In case of cancellation, refunds are processed within 14 days.

5. Inspection Obligation

1. The buyer is responsible for inspecting access to the software service upon activation and reporting any defects or discrepancies without delay.

6. Right of Withdrawal

1. The buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of contract conclusion without incurring any penalty or providing any justification.

8. Duration & Exceptions to the Right of Withdrawal

1. Under Article 15 of the Distance Contracts Regulation, contracts regarding "services started with consumer approval before the expiry of the right of withdrawal period" and "services performed instantly in electronic environments and intangible goods delivered to consumers instantly" are exempt from the right of withdrawal. Accordingly, cloud subscription services customized and activated with consumer authorization cannot be subject to withdrawal for the already-started service cycle.
2. In circumstances where the right of withdrawal applies, notice must be given in writing within the 14-day statutory period via email or certified mail.

9. Exercise of Withdrawal & Refund Terms

1. The seller shall return the total amount received to the buyer within 10 (ten) days following receipt of the valid withdrawal notification.
2. For corporate customers, a corresponding return invoice issued by the institution is required for completing refund transactions.

10. Default and Legal Consequences

1. In case of payment default involving credit card payments, the buyer agrees to pay interest in accordance with the credit card agreement with their issuing bank.

11. Payment and Delivery

1. Bank Transfer / Wire: Payments can be made to İkago's corporate bank accounts with company name and order reference in the payment description.
2. Online Credit Card Payment: Supported via 256-bit SSL secured payment infrastructure with single charge or installment options. Activation of the cloud service occurs immediately upon successful authorization.
